Nightfan

Terms of Use

Nightfan — last updated 23 September 2026

Nightfan is made by TEKBH, Switzerland ("we").

1. The agreement

By using Nightfan you agree to these terms. If you do not, delete the app. If you bought a subscription through Apple, Apple's own terms also apply and, where they conflict with these, Apple's win.

2. What the app is

Nightfan plays sounds intended to help people relax and sleep. That is all it is. It is not a medical device and it does not give medical advice. It does not diagnose, treat, cure or prevent anything, and it is not a substitute for a doctor, a midwife or a health visitor. If you have concerns about your own or a child's sleep, breathing or health, speak to a clinician.

3. Using it safely, especially around a baby

You are responsible for how loudly and how close you play it. Sustained loud sound can damage hearing, and an infant's hearing is more vulnerable than an adult's. The app ships with a nursery volume limiter on by default and with safe-listening guidance built in; please read it. Keep the device out of a cot, crib or bed, away from cables and away from where a child can reach it. Never leave a child unattended with a device.

4. Your licence

We grant you a personal, non-transferable, non-exclusive licence to use the app on devices you own or control. You may not copy, sell, rent, reverse engineer or redistribute the app or its sounds, and you may not extract the audio or the photographs for use elsewhere.

5. Other people's work

Some sounds and all of the photographs are published by others under Creative Commons or public-domain terms and are credited in the app under Settings. Those credits are part of the licences under which we use them; do not remove them. Everything else — the app, its design, its name and its generated audio — belongs to us.

6. Subscriptions

Nightfan offers an optional subscription. Prices are shown in the app in your local currency before you buy.

7. Changes to the app

We may add, change or remove sounds and features, including sounds delivered after you installed the app. We will not remove a feature you paid for while your subscription is running, unless we have to for legal or safety reasons.

8. No warranty, and the limit of what we owe you

The app is provided "as is". We do not promise it will be uninterrupted or error-free, or that a sound will help anybody sleep. To the extent the law allows, our total liability to you is limited to what you paid us in the twelve months before the claim. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited — and if you are a consumer, your statutory rights are unaffected.

9. Ending it

You can stop at any time by deleting the app. We may end your licence if you break these terms.

10. Law

These terms are governed by the laws of Switzerland, and the Swiss courts have non-exclusive jurisdiction. If you are a consumer you may also bring proceedings where you live.
